Flyflow.ai Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Flyflow.ai, our websites, apps, AI agents, workflow automation tools, browser-based features, connected-account integrations, and related services (collectively, the "Services"). The Services are provided by Aignite Inc., doing business as Flyflow.ai ("Flyflow", "we", "us", or "our").

By accessing or using the Services, creating an account, clicking to accept these Terms, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services.

IMPORTANT ARBITRATION NOTICE: These Terms include an arbitration agreement and class action waiver below. To the extent permitted by law, disputes will be resolved by individual binding arbitration rather than in court or through a class action.

Our Privacy Policy explains how we collect, use, disclose, and protect information, including information used for AI model training and service improvement. The Privacy Policy is available at https://flyflow.ai/privacy-policy.

1. Eligibility and Accounts

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with permission from a parent or legal guardian. You are responsible for providing accurate account information, safeguarding your credentials, and all activity under your account.

You may not share, sell, transfer, or misuse your account, subscription, credits, or access credentials. We may suspend or terminate accounts that violate these Terms, create risk, or are used for fraud, abuse, excessive load, unauthorized access, or unlawful activity.

2. The Services

Flyflow provides AI-powered tools that may help users create content, run workflows, complete digital tasks, generate documents or websites, organize files, interact with third-party tools, and produce other outputs. Features may change, be added, be removed, become paid, or be limited based on plan, usage, region, security, or operational needs.

We may impose limits on credits, storage, file size, execution time, model access, agent steps, rate limits, connected tools, or other usage parameters. We may modify or discontinue any feature at any time, subject to applicable law.

3. User Content, AI Outputs, and Ownership

"User Content" means prompts, instructions, uploaded files, documents, images, text, links, data, connected-account content, workflow inputs, feedback, and other materials you submit, upload, authorize, or make available to the Services. "Outputs" means content, files, documents, websites, code, automations, workflow results, summaries, transformations, or other materials generated by or through the Services.

As between you and Flyflow, you retain your rights in User Content, and we assign to you any rights we may have in Outputs to the extent permitted by applicable law and subject to your compliance with these Terms. You are responsible for determining whether Outputs are suitable for your intended use and whether they infringe or violate any third-party rights or laws.

You grant Flyflow a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, process, transmit, display, analyze, modify, create derivative works from, and otherwise use User Content and Outputs as necessary or useful to provide, operate, secure, troubleshoot, support, personalize, enforce, develop, train, fine-tune, evaluate, and improve the Services, AI models, AI systems, safety systems, workflow execution, and related products, as described in these Terms and our Privacy Policy.

You represent that you have all rights, permissions, and authority necessary to provide User Content to Flyflow and to allow Flyflow to process it under these Terms. You are responsible for ensuring that your User Content and use of the Services comply with applicable laws, contracts, third-party rights, platform rules, and organizational policies.

4. AI Features, Model Training, and Human Review

The Services use artificial intelligence and automation. AI-generated Outputs may be inaccurate, incomplete, offensive, non-unique, outdated, or unsuitable. You must independently review and verify Outputs before relying on them, publishing them, submitting them, making decisions based on them, or using them in business, legal, financial, medical, employment, academic, safety-critical, or other important contexts.

Flyflow may use User Content, Outputs, workflow results, prompts, uploaded files, connected-account data, agent logs, usage data, ratings, feedback, error reports, and other information processed through the Services to train, fine-tune, evaluate, test, debug, secure, personalize, and improve our AI models, AI systems, workflow execution, safety systems, and Services. These uses are subject to our Privacy Policy, user controls we make available, and applicable law.

We may use automated and human review to investigate abuse, improve quality, evaluate Outputs, troubleshoot technical issues, improve agent performance, develop safety systems, and enforce these Terms. We use commercially reasonable safeguards appropriate to the nature of the data and the Services.

Where we provide an opt-out or other setting for certain AI training or targeted advertising uses, you may use that setting or contact support@flyflow.ai. Some processing for security, debugging, service operation, legal compliance, fraud prevention, billing, and abuse detection may continue where permitted by law.

Information already used to train, fine-tune, evaluate, or improve models or systems may not be practically removable from model weights, aggregate analytics, or evaluation systems.

5. Connected Accounts, Agent Actions, and Backups

You may connect third-party accounts, APIs, websites, cloud storage, email, calendar, browser sessions, documents, project tools, or other services. By connecting an account or authorizing an integration, you direct Flyflow to access and process information from that third-party service according to the permissions you grant and the actions you request.

Agents may read, analyze, summarize, extract, create, transform, move, rename, update, organize, send, publish, or otherwise act on files, messages, records, websites, or other data that you upload, connect, or authorize. You are responsible for reviewing agent actions, limiting permissions, confirming important actions, and maintaining backups of important materials.

Flyflow is not responsible for loss, corruption, deletion, modification, or disclosure of data caused by your instructions, your connected third-party services, your account permissions, your failure to maintain backups, or actions you authorize, except to the extent liability cannot be limited by law.

6. Acceptable Use

You may not use the Services to:

Violate laws, regulations, contracts, third-party rights, platform rules, or organizational policies;

Access, extract, scrape, exfiltrate, modify, or disclose data without authorization;

Create, distribute, or facilitate malware, phishing, spam, credential theft, fraud, scams, impersonation, or deceptive activity;

Generate or automate unlawful, harmful, harassing, hateful, sexually exploitative, violent, or abusive content or conduct;

Bypass, disable, or undermine safety systems, rate limits, access controls, payment systems, usage limits, or security protections;

Reverse engineer, extract, copy, sell, or misuse our models, prompts, systems, source code, or proprietary content except as permitted by law;

Use Outputs as a substitute for professional advice or human judgment in high-risk contexts;

Upload sensitive personal information, confidential third-party data, trade secrets, or regulated data unless you have authority and the Services are appropriate for that use;

Overload, disrupt, attack, or interfere with the Services or any third-party service.

We may remove content, limit workflows, block tool calls, suspend access, or terminate accounts when we believe these Terms or our policies have been violated or when necessary to protect users, third parties, Flyflow, or the Services.

7. Subscriptions, Trials, Payments, and Refunds

Some Services require payment or credits. Prices, features, usage limits, renewal periods, and billing terms are shown at purchase or in the applicable product interface. Unless otherwise stated, subscriptions automatically renew until canceled. You authorize us and our payment processors to charge your payment method for applicable fees, taxes, renewals, upgrades, and other charges.

Trials, discounts, coupons, promotional credits, and limited offers may be subject to additional terms and may be modified or ended at any time. If a trial converts to a paid subscription, you will be charged according to the terms shown at signup unless you cancel before the trial ends.

You may cancel through the account, billing portal, app store, or payment flow where the subscription was purchased. Refunds are provided only where required by law or expressly stated in the applicable purchase terms. Chargebacks, failed payments, or suspected payment abuse may result in account restriction or termination.

8. Intellectual Property

Flyflow and its licensors own the Services, software, models, systems, workflows, interfaces, designs, trademarks, logos, documentation, and other proprietary materials. Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication or otherwise.

Subject to your compliance with these Terms, Flyflow grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes.

9. Third-Party Services

The Services may interoperate with third-party services, models, tools, websites, APIs, plugins, app stores, payment processors, or platforms. Third-party services are governed by their own terms and privacy policies. Flyflow does not control and is not responsible for third-party services, their content, availability, data practices, errors, or actions.

10. Disclaimers

THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FLYFLOW DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

Flyflow does not warrant that Outputs will be accurate, complete, unique, lawful, safe, or suitable for any purpose, or that agent actions will complete successfully or without unintended effects. You use the Services at your own risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLYFLOW AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, FLYFLOW'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FLYFLOW FOR THE SERVICES IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Flyflow and its affiliates, officers, employees, agents, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from or related to your User Content, your use of the Services, your connected accounts, your instructions to agents, your violation of these Terms, your violation of law, or your infringement or misappropriation of third-party rights.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, create risk, fail to pay fees, use the Services unlawfully, or if continued access could harm Flyflow, users, third parties, or the Services. Sections that by their nature should survive termination will survive, including provisions about ownership, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and payment obligations.

14. Dispute Resolution and Arbitration

Before filing a claim, you and Flyflow agree to try to resolve disputes informally by contacting support@flyflow.ai. If a dispute is not resolved informally, then, except where prohibited by law or where either party brings an eligible individual claim in small claims court, disputes arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules.

You and Flyflow waive the right to a jury trial and to participate in a class, collective, consolidated, private attorney general, or representative action to the extent permitted by law. Arbitration will be conducted on an individual basis. These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, except where local law requires otherwise.

You may opt out of this arbitration agreement by sending a written notice to support@flyflow.ai within 30 days after first accepting these Terms. The notice must include your full name, account email, and a clear statement that you opt out of arbitration.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Continued use of the Services after an update means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
